Terms and Conditions

Please read all these terms and conditions.

As BZZKTT accepts your order and makes a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with.

1. Application

  1. These Terms and Conditions will apply to the online purchase of the services provided by BZZKTT by you (known as you or the customer). BZZKTT is the sole property of Gavin Tyte (aka TyTe) of Kingfisher Cottage, St. Margaret’s Lane, Somerset, TA20 2RU, UK with the email address tyte@bzzktt.com (known as the supplier or us or we).
  2. These are the terns on which we sell the services of BZZKTT to you. By ordering any of the services, for example, purchasing the initial pack of sounds and patterns, you agree to be bound by these Terms and Conditions. you can only purchase the Services from the BZZKTT website if you are eligible to enter into a contract.

2. Interpretation

  1. Consumer or Customer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;
  2. Contract means the legally-binding agreement between you and us for the supply of services.
  3. Order means the Customer’s order for the Services from the Supplier as submitted following the step by step process set out on the Website.
  4. Privacy Policy means the terms which set out how we deal with confidential and personal information received from you via the Website.
  5. Services means the services advertised on the Website, including the number and description of any online content set out in the order.
  6. Website means our website bzzktt.com on which the Services are advertised.

3. Services

  1. The description of the Services is as set out in the Website, catalogues, brochures,  or other form of online or offline advertisement. Any description is for illustrative purposes only and there may be discrepancies in the audio or visual quality or quantity of any Services supplied.
  2. All Services which appear on the Website are subject to availability.
  3. We reserve the right to add, edit, remove, or replace any or all aspect(s) of any Service provided in the Website at any time and without any notice.
  4. We can make changes to the Services which are necessary to comply with any applicable law or safety requirement at any time and without any notice.

4. Customer Responsibilities

  1. You must co-operate with us in all matters relating to the Services.
  2. Services from the Website must not be shared, copied, transcribed, transformed, transmuted in any form at any time.
  3. We reserve the right to suspend, remove, ban, or block Consumers in breach of the terms and conditions at any time, terminating the contract, without any notice.

5. Personal Information and Registration

  1. When registering to use the Website you must set up a username and password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.
  2. We retain and use all information strictly under the Privacy Policy.
  3. We may contact you by using e-mail or other electronic communication methods and you expressly agree to this.

6. Basis of Sale

  1. The description of the Services in our website does not constitute a contractual offer to sell the Services. When an Order has been submitted on the Website, we can reject it for any reason without notification.
  2. The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
  3. A Contract will be formed for the Services ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing in a Order you agree to us giving you confirmation of the Contract by means of an email with all the information in it (i.e. the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract and not later than before performance of any of the Services.
  4. Once the contract is confirmed we agree to provide the Services for 30 days from the date of contract confirmation.
  5. No variation of the Contract, whether about description of the Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.
  6. We intend that these Terms and Conditions apply only to a Contract entered into you by you as a Consumer.

7. Fees and Payment

  1. The fees (Fees) for the Services is that set out on the Website at the date we accept the Order.
  2. Fees and charges include VAT at the rate applicable at the time of the Order.
  3. You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before deliver of the Services.
  4. The fees for the Services set out on the Website are subject to change at any time and without notice.

8. Delivery of Services

  1. We will deliver the Services (give you access to the online content) within a reasonable time.
  2. If Services have been delivered there is no ability to request a cancellation or a refund. No refunds are given on any Services provided by the Website.
  3. If Services have not been delivered within a reasonable time, you may request a refund upon which the contract will be terminated.
  4. At no point do you own the Services provided by the Website. The Services are licensed to you for your own personal use. All Services are solely owned and Copyright by the Supplier.
  5. Teachers may use the Services provided by the website with classroom sizes of 30 students or less. All other Terms and Conditions must be adhered to.

9. Accounts

  1. You may cancel your account at any time by submitting a request in writing. Your contract is terminated upon account cancellation. Services will be suspended upon account cancellation. Accounts may be re-instituted at the discretion of the Supplier.
  2. Accounts may be cancelled if you commit a breach of these Terms and Conditions, at any time and without notice.
  3. On termination of the Contract for any reason, any of our respective remaining rights and liabilities will not be affected.

10. Conformity

  1. We have a legal duty to supply Services in conformity with the Contract, and will not have conformed if it does not meet the following obligation:
  2. Upon delivery the Services will be of satisfactory quality and be fit for purpose. They will also conform to their description.

11. Governing Law, Jurisdiction and Complaints

  1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.
  2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the customer lives in Scotland or Northern Island, in the courts of respectively Scotland or Northern Ireland.
  3. Disputes must be put in writing via the email address. We will aim to respond within 5 days.
